Structure of the Bar in the Republic of Belarus

The legal profession in the Republic of Belarus is not a fully self-regulatory community and organization, in contrast to as provided for by international standards. At the same time, in the Belarusian Bar there is a number of management structures and self-government activities. These structures have undergone changes after the amendments to the legislation on the legal profession of November 30, 2021 came into force.
Bodies of the Bar self-government
The bodies of the Bar self-government in the Republic of Belarus are (1) the congress of the bar and (2) the bar association.

The Belarusian Republican Bar Association (BRBA) and territorial (Minsk city and regional) bar associations operate in Belarus.

BRBA is a non-profit organization based on compulsory membership of territorial bar associations. Among the functions of the BRBA are the representation and protection of the interests of attorneys in relations with government bodies and other organizations, coordination of the activities of territorial bar associations.

The territorial bar association is a non-profit organization based on compulsory membership of attorneys of a separate administrative-territorial unit. There are seven territorial bar associations in Belarus: Minsk city, Minsk regional, Mogilev regional, Grodno regional, Gomel regional, Vitebsk regional, Brest regional.
Congress of the Bar
Republican. The highest body of attorneys' self-government is the Congress of the Bar. The Congress is convened by the Chairman of the BRBA at the request of at least one third of the total number of members of the territorial bar associations. Representatives of territorial bar associations take part in the congress. The rate of representation from territorial bar associations is determined by the BRBA council, taking into account the need to ensure equal participation of representatives of all territorial bar associations, but not less than thirty representatives from each territorial bar association. The powers of the Congress of the Bar are:

consideration, within its competence, of current problems of improving the legal profession and advocacy;

discussing issues of improving the quality of provision and accessibility of legal assistance, making proposals on improving legislation to subjects of law of legislative initiative;

hearing a report from the BRBA chairman on the work of the BRBA council;

consideration of other issues of organizing the activities of the legal profession.



Territorial. The highest governing body of a territorial bar association is the general meeting (conference) of its members. A general meeting (conference) of members of a territorial bar association is held on the initiative of its council or at least one third of the members of the bar association, but at least once a year.

BRBA. The BRBA Council is a collegial executive governing body, formed from representatives elected for a term of four years at general meetings (conferences) of members of territorial bar associations - two representatives from each territorial bar association. The chairmen of territorial bar associations are ex-officio members of the council of the Belarusian Republican Bar Association; their candidacies must be approved by the Ministry of Justice.

The Chairman of the BRBA and his deputy are elected by members of the BRBA Council from the BRBA Council for a period of four years in agreement with the Ministry of Justice.

Territorial Bar associations. The council of the territorial bar association is a collegial executive governing body, elected at a general meeting (conference) of members of the territorial bar association for a period of four years. Meetings of the council are convened by its chairman and held at least once a month.

The chairman of the territorial bar association and his deputy (deputies) are elected from its council for a period of four years, their candidacies must be approved by the Ministry of Justice. Thus, the territorial collegium no later than a month before the meeting submits to the Ministry of Justice at least 2 candidates for each member of the council. If the Ministry of Justice twice rejects the proposed candidates, then the ministry presents its own candidates. If these candidates are rejected twice at the general meeting, the candidates from the Ministry of Justice are considered to be elected to the territorial council.
Audit committee
BRBA. To monitor the financial and economic activities of bar associations, an audit commission of the BRBA is elected for a period of four years, which includes one representative from each territorial bar association.

Territorial Bar associations. To exercise control over financial and economic activities in the territorial Bar associations, an audit commission consisting of at least three attorneys who are members of this territorial Bar association is elected for a period of four years.
Disciplinary Commission
The disciplinary commissions of the BRBA and territorial Bar association existed until November 30, 2021, however, after the amendments to the Law "On the Bar and Legal Activities" came into force, their functions are transferred to the councils of the territorial Bar association and the BRBA (Article 22 of the Law). The Council of the Territorial Bar association reviews disciplinary violations of attorneys; The Council of the Republican Bar association considers disciplinary violations of the chairmen and members of the councils of territorial Bar associations and considers complaints against decisions of territorial councils. Decisions of the council of the republican Bar association on complaints against decisions of territorial councils, as well as on bringing to administrative responsibility, can be appealed to the court within a month.

The BRKA Disciplinary Commission was the body authorized to consider cases of disciplinary liability against chairmen of bar associations, their deputies, as well as complaints against decisions to bring an attorney to disciplinary liability or to terminate disciplinary proceedings against an attorney.

The disciplinary commission of the territorial bar association was the body authorized to consider initiated disciplinary proceedings and monitor compliance by attorneys of the territorial bar association with the legislation on the legal profession, the Rules of Professional Ethics of Attorneys, the statutes of bar associations and law bureaus, decisions of the BRBA and the territorial bar associations.
